Complaints / Statutory Warranty
In case of any discrepancy, the Estonian version prevails / Vastuolude korral kehtib eestikeelne versioon.
1. Two-year conformity right
A consumer buyer may lodge a complaint within 2 years of the work being handed over, if the work does not conform to the contract (is defective). A defect is a lack of conformity that already existed at the time of hand-over.
2. Presumption in the first year
If a defect becomes apparent within the first year of hand-over, it is presumed to have existed at the time of hand-over unless the seller proves otherwise (the burden of proof is on the seller). After the first year the burden of proof lies with the buyer.
3. Who is responsible
Under the consignment model the seller is Ehted Inimestele OÜ, so Ehted Inimestele OÜ bears the statutory liability toward the buyer for every work sold on the platform. Your contracting party is never the artist, but Ehted Inimestele OÜ.
4. Order of remedies
- Repair or replacement — as a first step you may choose repair or replacement of the work (where both are possible and proportionate).
- Price reduction or cancellation — if repair/replacement fails, is impossible or disproportionate, or the seller refuses.
5. How to complain
Lodge a complaint by e-mail to info@ehtekunst.ee or via the return form. Describe the defect and, where possible, attach photos and the order number. We will respond within 15 days. If the defect is confirmed, Ehted Inimestele OÜ arranges repair, replacement or refund; internally this is resolved with the artist under the consignment agreement, but that does not concern your relationship with the seller.
6. Practical notes about jewellery (informational)
The following is not an exclusion of liability, but a clarification:
- Normal wear (patina, minor surface marks from wear) is not a defect.
- Resizing after purchase may be at the buyer's cost, unless clearly agreed otherwise.
- Commissioned/personalised works have a limited right of withdrawal (see Right of Withdrawal), but the 2-year statutory warranty applies to them too.
7. Dispute resolution
If we cannot reach agreement, you may turn to the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority (ttja.ee) or use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
