Terms of Service

1. Platform operator
The ehtekunst.ee platform is operated by Ehted Inimestele OÜ (osaühing, registry code 17048100, VAT No. EE102766983), located at Rataskaevu tn 20, Kesklinna linnaosa, 10123 Tallinn, Harju maakond, e-mail info@ehtekunst.ee (the operator or we). These Terms govern use of the platform as a service. Purchases of works and publications are additionally governed by the Terms of Sale.
2. What the service is
Ehtekunst.ee is a cultural archive of Estonian jewellery art: a register of works and artists, an exhibition database, a history archive, and editorial content. Some works and publications can be purchased through the platform — in that case the seller is Ehted Inimestele OÜ, which sells works taken from the artist on consignment (komisjonileping). The platform is not an intermediary or marketplace between third parties; it sells in its own name.
3. Accounts and eligibility
The content is publicly readable without an account. An account is needed to join as an artist, contributor or organization, and to manage purchases and favourites.
- Account holders must be at least 16 years old. The service is not directed at anyone under 16.
- Artist, contributor and organization accounts are activated after the operator's review and approval. Approval is a discretionary decision aimed at preserving the archive's integrity and reliability.
- You are responsible for the accuracy of your account details and for keeping your password safe. Notify us immediately of any misuse.
4. Acceptable use
Use of the platform is subject to the Acceptable Use Policy. Prohibited conduct includes unlawful content, infringing third-party rights, misrepresenting authorship or provenance, and circumventing the platform's intermediation.
5. User-submitted content
For content you add (profiles, work descriptions, texts, images) you grant us a limited licence under the Content Submission & IP terms. You retain copyright.
6. Intellectual property
Artists retain all rights to their works. The platform receives a limited, non-exclusive licence to display, index and archive works and metadata. The platform's own design, code, texts and database structure are protected and may not be used without permission.
7. Suspension and termination
We may suspend or terminate an account if you breach these Terms, the Acceptable Use Policy or the law, or where necessary to protect the platform or other users. For material breaches we will notify you and give reasons; you may object by e-mail. You may close your account at any time.
8. Service provided "as is"
The platform is a continuously developed cultural archive. The service is provided with reasonable effort, but we do not guarantee uninterrupted or error-free operation. Archive records are based on submitted and collected data; tell us about inaccuracies so we can correct them.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect damage arising from use of the platform as a service. We do not limit or exclude liability for intentional conduct or gross negligence — such a limitation would be void (§106(2) LOA). Nor does this clause limit your consumer rights in purchased works, which are governed by the Terms of Sale, Right of Withdrawal and Complaints / Statutory Warranty.
10. Governing law and disputes
Estonian law applies. Disputes are resolved in the Estonian courts. A consumer may turn to the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority (TTJA, ttja.ee) or use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
11. Changes to the Terms
We may amend these Terms. We will give reasonable advance notice of material changes and show the new effective date. Changes do not apply retroactively to purchase contracts already concluded. If you do not accept a change, you may close your account.
